1. Agreement to Terms

By accessing or using ASW Tutors' services ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our services.

These Terms apply to all visitors, users, and others who access or use our tutoring services, including our website, live classes, materials, and related services.

2. Services Description

ASW Tutors provides online mathematics tutoring services for Grade 8-12 students in South Africa. Our services include:

• Live group lessons (number of sessions varies by tier)
• Educational materials (notes, worksheets, quizzes)
• Access to recorded sessions (Exam Booster and Maths Mastery tiers)
• WhatsApp support (varies by tier)
• Monthly progress tracking
• Past paper workshops (Exam Booster and Maths Mastery tiers)

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

3. Registration and Eligibility

Eligibility

• Students must be enrolled in Grades 8-12 in South Africa
• Students under 18 require parent/guardian consent and supervision
• You must provide accurate, current, and complete information during registration

Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• One account per student; account sharing is prohibited

4. Pricing and Payment Terms

Subscription Tiers

• Tier 1 - Study Support: R299/month
• Tier 2 - Exam Booster: R399/month
• Tier 3 - Maths Mastery: R499/month

Payment Terms

• Payments are due monthly in advance on the 1st of each month
• Payment methods accepted: Bank transfer, credit/debit card, or other approved methods
• Late payments may result in temporary suspension of services
• Prices are subject to change with 30 days' notice
• All prices are in South African Rand (ZAR) and include VAT

Refund Policy

• First-time students: Full refund available within first 7 days if not satisfied
• No refunds for partial months or missed classes due to student absence
• Refunds processed within 14 business days to original payment method

5. Cancellation and Termination

Your Right to Cancel

• You may cancel your subscription at any time by contacting us at asw.tutors@outlook.com
• Notice required: 7 days before the next billing cycle
• Access continues until the end of the current paid period
• No refund for the remaining days of the current month

Our Right to Terminate

We may suspend or terminate your access immediately if:

• You violate these Terms of Service
• You engage in disruptive or inappropriate behavior
• Payment obligations are not met
• You share account credentials or course materials
• Any fraudulent activity is detected

6. Attendance and Participation

• Students are expected to attend scheduled live sessions
• Notify us at least 24 hours in advance if unable to attend
• Recordings available for higher tiers if a session is missed
• No make-up sessions for missed classes due to student absence
• We will notify you of any instructor-initiated cancellations and provide make-up sessions
• Expected conduct: Respectful behavior, active participation, and adherence to class guidelines

7. Intellectual Property Rights

Our Content

All course materials, including but not limited to notes, worksheets, videos, quizzes, and other educational content, are the intellectual property of ASW Tutors. You may not:

• Reproduce, distribute, or sell our materials
• Share course materials with non-enrolled individuals
• Record or screen capture live sessions without permission
• Use materials for commercial purposes or other tutoring businesses

Your Content

By submitting content (homework, questions, feedback), you grant us a license to use it for educational and service improvement purposes. We will not share your personal work publicly without consent.

8. User Conduct

You agree not to:

• Use the service for any unlawful purpose or in violation of these Terms
• Harass, threaten, or disrespect tutors or other students
• Disrupt live sessions or interfere with others' learning
• Attempt to gain unauthorized access to our systems or data
• Upload malicious code or viruses
• Impersonate another person or entity
• Engage in any form of cheating or academic dishonesty

9. Disclaimers and Limitations of Liability

No Guarantee of Results

While we strive to provide high-quality tutoring, we cannot guarantee specific academic results or exam performance. Individual results depend on many factors including student effort, attendance, and prior knowledge.

Service Availability

We aim for 99% uptime but cannot guarantee uninterrupted access. Technical issues, maintenance, or unforeseen circumstances may temporarily affect service availability. We are not liable for damages resulting from service interruptions.

Limitation of Liability

To the maximum extent permitted by law, ASW Tutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Data Protection and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Communications

By registering, you agree to receive communications from us including:

• Service updates and class schedules
• Educational content and tips
• Billing and payment reminders
• Marketing communications (you can opt-out of these at any time)

Communications may be sent via email, WhatsApp, SMS, or through our platform.

12. Third-Party Services

Our services may integrate with or link to third-party platforms (e.g., video conferencing, payment processors). We are not responsible for the availability, content, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts of South Africa.

Informal Resolution

Before pursuing formal legal action, we encourage you to contact us at asw.tutors@outlook.com to attempt to resolve the issue informally.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website at least 30 days before taking effect. Your continued use of our services after changes constitute acceptance of the updated Terms. If you do not agree to the changes, you must cancel your subscription.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ASW Tutors regarding the use of our services, superseding any prior agreements.
